We have wide-ranging experience in all types of bankruptcy, receivership and creditors' rights matters, including:
* Representation of secured creditors, select debtors and purchasers in individual and business bankruptcy and receivership cases, and in workouts, restructurings, liquidations and foreclosures.
* Assisting banks, other institutional lenders, real and personal property lessors, creditors’ committees and others in commercial and consumer bankruptcy and other insolvency litigation.
* Prosecution and defense of insolvency-type suits and other actions, including fraudulent transfer, leveraged buy-out litigation, preference and other avoidance-type litigation, claims disputes, subordination actions, asset acquisition disputes, contested plan confirmations, cram-down and valuation issues and appeals arising out of such proceedings.
* Representation, both regionally and nationally, of institutional consumer lenders in a broad range of consumer bankruptcy issues, federal compliance litigation, disputes and appeals, including appeals before federal courts and bankruptcy appellate panels, in Rhode Island, Massachusetts, Connecticut and Los Angeles, California, as well as before the United States Courts of Appeals for the First (Boston), Second (New York City), Ninth (San Francisco), and Eleventh (Atlanta) Circuits. We were also successful in jointly handling a noteworthy bankruptcy appeal before the United States Supreme Court.
* Serving many years as a court-appointed trustee, receiver, mediator and special master in reorganizations and liquidations, as well as counsel to such functionaries, in federal and state insolvency matters.
Our work in this area also extends to litigation and attempts to achieve practical and cost-effective resolutions of contested corporate deadlocks and other disputes in commercial cases.

Matthew J. McGowan works principally in the areas of bankruptcy, receivership and insolvency law. Prior to joining the Firm in 1985, Mr. McGowan was an attorney in the United States Trustee’s office in Boston, Massachusetts, representing that office in Chapter 11 cases in Boston, MA, Providence, RI, and Manchester, NH.
The focus of his practice is the representation of select corporate and other debtors, banks, credit unions and other institutional lenders, creditors’ committees, acquirers, lessors and other parties in workouts, bankruptcy reorganizations, liquidations, and litigation, as well as state court receiverships.
Mr. McGowan also serves as counsel to numerous consumer lenders, including representing their interests in bankruptcy and related litigation and appeals, both regionally and nationally.
He was a Chapter 7 trustee in Rhode Island for 14 years and continues to serve as a state court appointed receiver, trustee, arbitrator, mediator and master in insolvency matters. He is board certified by the American Bankruptcy Board of Certification in both business and consumer bankruptcy law, has authored published articles, contributed to a national bankruptcy publication, and has spoken extensively about bankruptcy and insolvency matters. He formerly taught bankruptcy law at Roger Williams University School of Law. He is a graduate of the University of Rhode Island and Catholic University of America School of Law.
